September 15, 2008 Board of Selectmen Meeting Summary 

1. Read Mail/Sign Warrant - Littleton Days September 20-21, 2008; MMA Legislative Briefing October 17th in Boxborough.

2A. Joint Meeting with Planning Board, Zoning Board of Appeals - Use Variances - continue to research for the May 2009 Annual Town Meeting a proposed zoning amendment to eliminate the Zoning Board of Appeals’ authority to issue use variances; also research whether notice requirements can be imposed to require certified mailing of abutters with the cost of such notice passed onto the applicant.

2B. Rezoning Petition - vote not to support the proposed zoning amendment to rezone the following parcels from Residential to Business: Map U5, Parcels 1, 2 & 2-1; Map U6, Parcels 2, 3, and 2-5, insofar as this proposal is inconsistent with the Board of Selectmen's FY 2009 goal to "promote economic development that is consistent with community character by focusing development and redevelopment efforts on properties that are already zoned for business or industrial uses, including consideration of expanded uses for those lands; while preserving open space and agricultural lands."

4. Public Hearing: Common Victualer License Application: Littleton Café & Bakery, 341 King Street - vote, pursuant to MGL C.140,§6, to approve the application of Elaine M. Carlo, Littleton Café & Bakery for a common victualler license for premises at 341 King Street, Littleton, subject to the final approval of the Nashoba Associated Boards of Health.

5. Police Station Construction Project Update/Presentation - see PowerPoint presentation on police station construction project, for which the bid opening is Friday, October 10, 2008. Project to go to October 20, 2008 Special Town Meeting for construction funding, with debt exclusion ballot question on November 4, 2008 state election ballot.

6A. Update on Ballot Question - On September 12, 2008, the Governor filed, and on September 15, 2008, the Massachusetts House of Representatives and State Senate passed, the special act requested by the Board of Selectmen on September 8, 2008 to have the police station construction debt exclusion ballot question appear on the November 4, 2008 state election ballot.  The bill-- Chapter 332 of the Acts of 2008-- was signed into law by the Lt. Governor on September 16, 2008.

6B. Insert Articles on Special Town Meeting Warrant - vote to insert the following articles onto the October 20, 2008 Special Town Meeting warrant, subject to approval as to form by Town Counsel: Bills of Prior Years; FY 2009 Line Item Transfers; New Police Station Construction; School Grant Funds; Shaker Lane School Fire Alarm System; Water Department Capital Improvements; Home Rule Petition Pension Obligation Bonds; Adoption of Local Room Occupancy Excise Tax; Increase Historical Commission Membership from Five to Seven Members.

7A. Minutes Approval - vote to approve the minutes of August 25, 2008 and September 8, 2008.
