March 30, 2009 Board of Selectmen Meeting Summary 

1. Read Mail/Sign Warrant

2. May 4, 2009 Annual & Special Town Meeting warrants determine order in which articles appear - vote to direct the constable to post the warrants for the May 4, 2009 Annual and Special Town Meetings, with the ordering of articles thereon as directed by the Board of Selectmen.  See order of articles.

3. Public Input

  • Fletcher property rezoning - Has the owners' attorney yet provided a draft memorandum of agreement relative to the proposed rezoning of the Fletcher property, as offered at the Planning Board's 3/26/09 public hearing? TA to follow up with Attorney Deschenes. (UPDATE - property owners' attorney submitted draft agreement on 4/3/09)
  • Can additional town board meetings be televised? TA to ask the Cable Advisory Committee to review the status of the Town's contract with Comcast, and see what technical issues would need to be addressed.  

4A. Russell Street School Repairs Project Update - Report on MSBA meeting - On March 25, 2009, the Massachusetts School Building Authority board of directors unanimously voted to approve Littleton's project for repairs to the Russell Street School, MSBA established the district total project budget at $15,131,820 with a reimbursement rate of 47.84%. As reported in the letter from MSBA Executive Director Katherine Craven, the approximate total grant amount is $7,058,664.  At that level, the resulting local cost would be $8,073,156.  Presentation on this project to be held on Thursday, April 9, 2009 at 7 PM at the Russell Street School.

4B. Insert Debt Exclusion Question on May 9, 2009 Annual Town Election ballot - vote, pursuant to MGL C.59, §21C, clause k, to insert the following debt exclusion ballot question onto the May 9, 2009 Annual Town Election ballot: "Shall the Town of Littleton be allowed to exempt from the provisions of Proposition two-and-one-half, so called, the amounts required to pay for the bonds issued in order to repair and renovate the existing Russell Street School?"

5A. Highway: Pay As You Throw - information still being compiled from neighboring communities. A follow-up agenda item to be scheduled.

5B. Police Chief: Reserve Police Officers  - the Board of Selectmen unanimously voted (1) to grant an exception to the hiring freeze policy for the filling of four reserve police officer positions; (2) to appoint two present employees, Tim Bemis and Brian Casey, to the position of Reserve Police Officer for the purpose of performing Detail Officer functions and Patrol/Detail officer functions, respectively; and (3) to appoint Michael Crory and Michael Sander as Reserve Police Officers for the purpose of performing Patrol and Detail Officer Functions.

  • The Board also authorized a grant application to be submitted under the COPS Hiring Recovery Program in the federal stimulus package, with acceptance of any grant award to be subject to approval by the Board of Selectmen.

5C. Fire Chief: On call Firefighters - vote to grant an exception to the hiring freeze policy for the filling of call firefighter positions.

6A. FY 2010 Budget Update - While Governor Patrick announced additional Chapter 70 funds on March 19, 2009, the State Legislature has not yet adopted its Chapter 70 funding amounts. As such, the Town's recommended budget for FY 2010 remains unchanged.

6B. Reconstituting Littleton MBTA Advisory Committee - vote to reactive and reconstitute a seven-member Littleton MBTA Advisory Committee to revisit the location of the Littleton commuter rail station which maximizes local and regional benefits while minimizing adverse impacts on the town, and addresses also economic impact, access, and parking issues, and to make its report to the Board of Selectmen within three months. TA to be the committee's intermediary with the MBTA. The Board also establish a deadline of April 10, 2009 at noon for applications to the Littleton MBTA Advisory Committee, with appointments to be made on April 13, 2009.

  • Update from Fitchburg Line Working Group meeting on 3/30/09 -  Federal stimulus funds will be applied to the Fitchburg Line project  to add dual-tracking from South Acton to Ayer, with handicapped accessibility upgrades to the Littleton commuter rail station. TA to schedule meeting with MBTA officials and State Senator Jamie Eldridge for project update. 

7A1. One-day Beer & Wine License Indian Hill Music Center 4/26/09 - vote, pursuant to MGL C.138,§14 to issue special one-day beer and wine licenses to Indian Hill Music, 36 King Street, Littleton, for an event to be held on Sunday, April 26, 2009 from 2:30 to 6:30 PM, with issuance subject to the applicant’s first obtaining host liquor liability insurance coverage.

7A2. Nagog Hill Orchard -Signage, Lease -  table the matter of whether to grant approval under the Littleton Sign By-law §173-34(C)-- pending receipt of a request from Charles J. Auger of Morrison/Nagog Hill Orchard Lessee, Nagog Fruiters, Inc., for the installation of signage on public property; vote to refer to the Agricultural Commission for its review and recommendation regarding the future disposition of the Morrison/Nagog Hill Orchard property, the ten-year lease for which expires on December 31, 2009.

7A3. BOS future meeting schedule -vote to schedule the following meetings for the months of April, May, and June 2009:

  • Monday, April 13, 2009 at 7 PM including joint meeting with the Planning Board and MassDevelopment re: transportation study
  • Monday, April 27, 2009 at 7 PM
  • Monday, May 4, 2009 at 6:30 PM prior to Town Meeting
  • Monday, May 11, 2009 at 7 PM
  • Monday, June 1, 2009 at 7 PM
  • Monday, June 15, 2009 at 7 PM
