September 21, 2009 Board of Selectmen Meeting Summary 

1. Read Mail/Sign Warrant

  • Request received for CART (computer assisted real-time) captioning services for all town meetings. Request for CART provider to be filed with the Massachusetts Commission for the Deaf and Hard of Hearing.

3. Public Input

4A. School Building Committee: Russell Street School Repairs - vote pursuant to Article 4 of the May 4, 2009 Special Town Meeting, and as chief executive official and "eligible applicant" under 963 CMR 2.02, to accept the September 9, 2009 recommendation of the School Building Committee and execute a Project Funding Agreement with the Massachusetts School Building Authority (MSBA) for repairs to the Russell Street Elementary School.

4B. Permanent Municipal Building Committee: New Police Station, Houghton Memorial Building roof, Littleton Track - The Board heard updates on the construction of the new police station at 500 Great Road, the repair of the roof for the Houghton Memorial Building, and the track feasbility study.

  • Littleton Historical Society, which donated $48,000 towards the Houghton Memorial Building roof repairs (18% of the total project cost of $263,000), has proposed that in the event the total project cost is less than $263,000, the Society receive a rebate equal to 18% of that amount. 

5. 215 Harwood Avenue Violations of Nuisance Agreement - vote to find that the terms of the December 3, 2007 agreement between the Town, 215 Harwood Avenue property owner Joseph Pittorino, and contractor W.L. French Excavating Corporation have been violated, and that as a consequence, the Board of Selectmen shall reschedule for Monday, September 28, 2009 at 7:30 PM the nuisance hearing begun on November 19, 2007, pursuant to MGL c.139, §§1-3A, and to give written notice of said rescheduled hearing to the parties.

  • review whether to request a MEPA review of the activity at 215 Harwood Avenue

6A. DEP Technical Assistance Evaluating Solid Waste Options - vote to establish a steering committee to work with Town staff on a project to evaluate solid waste options, for which DEP has committed to provide the Town with eighty (80) hours of in-kind technical assistance, with said steering committee to be comprised of at least five members, including a representative from the Board of Health, the Board of Selectmen, the Highway Department, and citizens at-large.

6B. Littleton Common Overlay District Update - The Planning Board and Board of Selectmen next meeting jointly on Thursday, September 24, 2009 to continue the discussion on the Littleton Common Overlay District Study and proposed zoning amendments for the Fall 2009 Special Town Meeting. The Board of Selectmen looks forward to participating in the September 24th meeting with the Planning Board.

  • Growth Districts Initiative - EOHED Secretary Greg Bialekci has asked Littleton, Boxborough, and Westford to identify areas in each town which might potentially become part of a growth district.

6C. Hiring Freeze Exemption Request: Board of Health - vote to grant an exception to the hiring freeze policy for the filling of part-time Administrative Assistant hours for the Board of Health budgeted at up to 25 per week for FY 2010; and, further, that such approval be conditioned upon the execution of a Memorandum of Agreement between the Board of Selectmen and the Board of Health relative to the assignment of said hours to one or more existing part-time employees who shall be under the supervision of the Town Administrator or his designee, with feedback on this organizational structure by March 30, 2010.

6D. Calling a Fall 2009 Special Town Meeting - vote, pursuant to MGL C.39,§10, to call a special town meeting for Monday, November 9, 2009 at 7 p.m. in the Charles Forbes Kaye Gymnasium, Littleton Middle School, 55 Russell Street; with the warrant therefor to open on September 28, 2009 and close on Friday, October 9, 2009 at noon.

7A1. MART COA authorization - vote to authorize the Director of the Council on Aging with the approval of the Assistant Town Manager for Finance and Budget to act on behalf of the Town of Littleton Board of Selectmen in submitting requests for reimbursement of services to the Montachusett Regional Transit Authority under MGL Chapter 161B.

7A2. One-day Beer & Wine License Application: St. Anne Parish 10/24/09 - vote, pursuant to MGL C.138,§14 to issue special one-day beer and wine licenses to Saint Anne Parish, 75 King Street, Littleton, for an event to be held on Saturday, October 24, 2009 from 4 to 9 PM, with issuance subject to the applicant’s first obtaining host liquor liability insurance coverage.

7B. Minutes Approval - vote to approve the minutes of August 24, 2009

7C. TA Review - Selectmen to complete reviews by next Monday, to be collated by the Chairman.

8. Collective Bargaining - Littleton Dispatch Unit - The Board of Selectmen unanimously voted to ratify a one-year contract with the Littleton Dispatch Unit, MCOP Local 204A for the period July 1, 2009 through June 30, 2010 at 0%.
