September 28, 2009 Board of Selectmen Meeting Summary
1. Read Mail/Sign Warrant
- New telephone numbers announced for Town Departments. All numbers will begin with 978-540-???? See announcement.
- MBTA Advisory Board survey inviting input from cities and town by October 15th.
2. Public Input
3. Nuisance Hearing: 215 Harwood Avenue -
- vote to find that Joseph Pittorino has violated the terms of the December 3, 2007 agreement between the Town, 215 Harwood Avenue property owner Joseph Pittorino, and contractor W.L. French Excavating Corporation.
- vote to determine that a nuisance does exist relative to activity at 215 Harwood Avenue and that the unlawful or unreasonable use of the property creating sources of filth and risks to public health and safety is a nuisance, and that the Board of Selectmen further vote, pursuant to MGL c.139, §3 and MGL c.111, §123, to require the property owner to remove the nuisance at his expense in accordance with the following abatement measures and time periods: cease and desist all and any truck delivery to and from 215 Harwood Avenue effective immediately, and to direct Town Counsel to draft an order in accordance therewith.
- ask for clarification from Town Counsel on the enforcing authority for this order
- ask the TA to notify all regulatory boards of the Board of Selectmen's findings and request their assistance relative to any regulatory violations on this property
- reports requested from the Conservation Commission, the Board of Health, and the Building Commissoner,
4. Highway Department – Plowing Sanding Private Ways – List of Roads - vote, pursuant to its August 28, 2000 policy on plowing/ sanding private ways to approve the list of roads as recommended by Highway Operations Manager Jim Clyde in his report dated September 23, 2009, as follows:
Approved without further conditions: Baron Way, Barr Place, Countryside Road, Cricket Lane, Deer Run Road, Foss Place, Great Road (#504 - #512), Green Needles Road (Back half), Green Needles Road (Nashoba Woodlands section), Hiddenwood Path, Omega Way, Robinwood Road, Silver Birch Lane, Whispering Pine Drive, Whitcomb Avenue: (#139 to # 149), and Winged Cove Road.
Approved subject to conditions set forth by the Highway Operations Manager:, Nashoba Road (Nashoba Day Camp); Oakridge Road, Rock Place, and Starr Hill.
5. Permanent Municipal Building Committee: Sign Permit for New Police Station - vote, pursuant to §173-34 of the Town Code, to grant a permit to the Permanent Municipal Building Committee to build and place a sign for the new police station on Town-owned property at 500 Great Road.
6. Appointment: Historical Commission - vote, pursuant to MGL C.40,§8D, to appoint John Leger to the Historical Commission for a term expiring June 30, 2010.
7A. Designate Liaison to State Ethics Commission [MGL C.268A,§29] - vote, pursuant to MGL C.268A,§29, to designate Town Clerk Diane Crory as the Town of Littleton’s liaison with the State Ethics Commission.
7B. Littleton Common Overlay District - The Board of Selectmen and Planning Board next meet on Thursday, October 1, 2009 at 7:30 PM to continue discussions about the Littleton Common Overlay District with Mark Racicot of the Metropolitan Area Planning Commission. 7C. November 9, 2009 Special Town Meeting – insert articles - vote to insert the following articles onto the November 9, 2009 Special Town Meeting warrant, subject to approval as to form by Town Counsel:

- M.H. Kimball Trust Funds for School Grant
