2024/25 Marijuana Bylaw Amendments
The Planning Board held a Public Hearing on Thursday, March 13, 2025 at 7:30 p.m. in Room 103 of the 37 Shattuck Street Town offices.
At the March 13, 2025, Public Hearing, the Planning Board unanimously voted to recommend the proposed Marijuana Cultivation Facilities Bylaw Amendment to bring forward to Town Meeting.

Planning Board Public Hearing - March 13, 2025
In response to concerns raised by residents, the Planning Board is proposing to bring two amendments to the marijuana zoning bylaw to the May 6, 2025 Town Meeting. The first proposed amendment would prohibit Marijuana Cultivators and Craft Marijuana Cooperatives, as well as Microbusiness that cultivate Adult Use Marijuana. The second proposed amendment would clarify the Air Quality Special Permit requirements applicable to Medical Marijuana Treatment Centers. The proposed amendments would not further limit the number of Medical Marijuana Treatment Centers allowed in Town - there is only one Special Permit that can be allowed for a Medical Marijuana Treatment Center that cultivates marijuana. This proposal follows the vote from the October 2024 Town Meeting. The proposed ban on Adult use Marijuana cultivation facilities would require both Town Meeting approval (2/3 vote required) and a separate ballot vote at a local election.

Fall 2024 Town Meeting approved Article 5 that limited the number of possible marijuana cultivation facilities in Town to the minimum number allowed under State Law without a ballot vote. The Planning Board will bring another bylaw amendment to the May 2025 Town Meeting to further reduce the number.

The Planning Board is considering a 2-step approach to amend the Marijuana zoning bylaw. First, at Fall 2024 Town Meeting, the Board would propose amendments to the existing bylaw to update the bylaw and to limit the number of marijuana cultivation sites that could be allowed to the minimum allowed by State law without a local ballot question.
If Town Meeting passes that amendment, another amendment could be moved forward to the Spring 2025 Town Meeting to prohibit any (new) commercial marijuana cultivation sites. That update would also require a ballot vote in May 2025. Discussion and vote at the Fall Town Meeting will provide important feedback to the Planning Board on this matter.
